This page sets out the terms governing services purchased from Varghis LLC ("Varghis," "we," "us"). By engaging our services and submitting payment, you ("Client") agree to these terms. These terms supplement any signed service agreement; in the event of a conflict, the signed service agreement controls.
Varghis provides automation services for local service businesses, including missed-call recovery, AI-driven appointment booking, lead-response automation, and related workflow services. Specific deliverables, scope, and inclusions for each engagement are set forth in the Client's signed service agreement.
The pricing listed below is the baseline pricing for Varghis's core Missed Call to Booked Appointment service. Pricing for additional services — including expanded automation workflows, custom integrations, and advisory engagements — is quoted on a per-engagement basis and set forth in the Client's signed service agreement.
Missed Call to Booked Appointment — Baseline Pricing
Setup Fee: $1,000 (one-time, charged at engagement start)
Monthly Retainer: $497 (recurring, billed monthly in advance)
Pricing is subject to change for new engagements with notice. Pricing for active Clients is locked at the rate stated in their signed service agreement for the duration of the term.
Setup Phase. Setup work begins within 3 business days of (a) signed service agreement and (b) receipt of the setup fee. Setup is targeted for completion within 14 calendar days, contingent on the Client providing required access (booking platform credentials, phone number, business information) within agreed timelines. Delays caused by Client unresponsiveness do not extend the monthly billing schedule.
Ongoing Service. The monthly retainer covers active workflow operation, performance monitoring, monthly reporting, prompt and content refinement, and one (1) 30-minute monthly review call. Additional workflows, custom integrations, and ad-hoc development are quoted separately.
Setup fees are charged upon execution of the service agreement via Stripe. Monthly retainer charges begin on the date setup is completed (the "Go-Live Date") and recur on the same day each month thereafter. Payment is collected via Stripe using a credit card, debit card, or ACH on file. Failed payments will be retried automatically; service may be paused after 7 days of non-payment and terminated after 30 days of non-payment.
The Client may cancel the monthly service at any time by providing 30 days written notice via email to [email protected]. The Client will be billed for one final monthly cycle following the notice date. Upon cancellation:
Varghis reserves the right to terminate service with 30 days notice if Client is in material breach of the service agreement or if continued service would violate applicable law.
Services involve sending SMS messages to Client's customers on Client's behalf. Client is responsible for ensuring all contacts have provided valid prior express written consent under the Telephone Consumer Protection Act (TCPA) and applicable state law. Varghis maintains TCPA-compliant opt-in language and STOP/HELP keyword handling on all workflows it builds; Client is responsible for honoring opt-outs and maintaining suppression lists.
Use of our services is also governed by our Privacy Policy. Varghis processes Client and end-customer data solely to deliver services and does not sell personal data.
Varghis's total liability under any engagement is limited to the fees paid by the Client in the 3 months preceding the claim. Varghis is not liable for indirect, incidental, or consequential damages, including lost revenue or business interruption.
These terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute shall be resolved in the state or federal courts located in Middlesex County, Massachusetts.
